It might seem like yes he should be charged with the death penalty there is a problem. If you put Kael to death the imperial family sided with a traitorous duke. This is in a time where “nationality” isn’t really a thing. You couldn’t even suggest a king was committing treason by helping the enemy because you followed the lord of the land not the nation. So while there is laws, the ultimate decision of punishment especially for something like this would fall to the ruler and they already determined he was just in helping the crown eliminate a noble with an illegal army meant for treason. Plus they already discussed this in a court or he would already be dead.
Not to mention many nobles actually got info like this from tea parties like this. Husbands talk to wives, wives talk to each other and relay back to husbands/parents/siblings and what not so not only would there be talks like this it was also a way to gauge peoples alliances with factions.

while it does need to get brought up, uhhh… i don’t know that this is the correct venue for it. murdering a duke and duchess is probably one of them death-penalty charges and daring her to impose those charges is a gamble i personally wouldn’t make without a preponderance of public opinion staying her hand. if you’re surrounded by nobles, you don’t have the same support lined up and can’t expect to garner it
